Terms and Conditions of Sales for Lessons

Article 2. Description of Services and Technical Prerequisites
"Parlons French" offers online French language lessons.
Format: Lessons are conducted exclusively remote via the Google Meet platform.
Session Duration: The standard duration of a lesson session is either 50 minutes or 30 minutes, depending on the package selected by the Student.
First Evaluation Session: Students may book an initial 50-minute lesson. This introductory session serves to get to know one another, discover the instructor's teaching method, assess the Student's current language level, and mutually establish their French learning goals.
Technical Prerequisites: The Student agrees to have functional computer equipment (a stable, high-speed internet connection, a webcam, and a microphone) to ensure the smooth running of the lessons on Google Meet. Technical failures on the Student's end will not entitle them to any refund or rescheduling of the lesson.
Article 3. Booking Process and Acceptance of the Terms and Conditions
Acceptance of these Terms and Conditions is mandatory for any service booking.
Method of Acceptance: This acceptance is finalized by checking a mandatory box when booking the first session on the website www.parlonsfrench.com.
Any validated booking implies the Student's full and unreserved adherence to these Terms and Conditions.
Article 4. Pricing and Payment Terms
4.1 Pricing
The applicable rates are as follows:
First Evaluation Session (50 minutes): 28 USD (special introductory rate)
Standard 30-minute Session: 34 USD
Standard 50-minute Session: 59 USD
4.2 Payment Terms and Currencies
Payment is due one month in advance, strictly before the first lesson of the billed month.
Although the reference rate is stated in USD, transactions can be made in the following currencies: US Dollar (USD), Euro (EUR), British Pound (GBP), Swiss Franc (CHF), or Canadian Dollar (CAD).
4.3 Payment Platform
All transactions are handled exclusively via the secure platform Wise. Accepted payment methods include:
Bank transfer (to a local Wise account opened in the chosen currency).
Apple Pay.
Google Pay.
Credit card (Visa or Mastercard).
Article 5. Cancellation, Rescheduling, and Late Policy
5.1 Lateness ("No Show")
If the Student is more than 10 minutes late for the start of a scheduled session, the lesson will be considered canceled due to the Student's fault. The session is fully due and will not be eligible for any refund or rescheduling.
5.2 Cancellation or Rescheduling Request by the Student
Request made at least 24 hours in advance: Rescheduling the lesson is at the sole discretion of the instructor. If rescheduling is impossible due to schedule constraints, the canceled lesson will result in a one-lesson credit applied to the following month's invoice.
Request made less than 24 hours in advance: The lesson is considered fully due. No refund, rescheduling, or credit will be granted.
5.3 Modification or Cancellation by the Instructor
In the event that the instructor is unable to attend, notice of one week will be sent to the Student whenever possible.
If the lesson canceled by the instructor cannot be rescheduled to a later date by mutual agreement, the value of that lesson will be credited to the following month's invoice.
Article 6. Right of Withdrawal
In accordance with the French Consumer Code applicable to remote digital service contracts, and given that the execution of online lessons begins immediately after the Student's express consent and before the end of the legal withdrawal period, the Student acknowledges that they expressly waive their right of withdrawal for services consumed or fully executed. For any service that has not yet started, the termination terms outlined in Article 10 shall apply.
Article 7. Best Efforts Obligation and Student Responsibility
The instructor commits to applying all her skills and expertise to guide the Student toward the success of their learning project.
The instructor and the Student define the goals to be achieved together.
Based on her professional expertise, the instructor can outline an estimated timeframe to guide this learning process.
The instructor provides maximum support to the Student. However, because language learning relies heavily on personal factors, the teaching service provided by "Parlons French" constitutes an obligation of means (best efforts) and not of result. The final outcome depends entirely on the Student's personal investment, regular practice, and remains their sole responsibility.
Article 8. Intellectual Property
All educational materials, documents, exercises, texts, or resources shared by the instructor before, during, or after lessons remain the exclusive property of "Parlons French." The Student is granted a strictly private and personal right of use. Any reproduction, distribution, sharing, or commercial exploitation of these materials without the prior written consent of Estelle Materne is strictly prohibited.
Article 9. Personal Data Protection and AI Transcriptions
As part of pedagogical improvement, lesson sessions may be automatically transcribed to generate personalized vocabulary lists for the Student.
Confidentiality: All data resulting from these transcriptions is strictly confidential.
Restricted Use: This data is under no circumstances shared with third parties, nor is it used to train Artificial Intelligence (AI) models.
Right to Object (Opt-out): The Student has the right to refuse the use of this transcription tool at any time. Exercising this opt-out right effectively cancels the generation and subsequent delivery of the associated vocabulary lists.
Article 10. Duration, Suspension, and Termination of Service
The service contract may be terminated at any time by either party subject to the following notice periods:
Termination by the Student: The Student may terminate the service with a 24-hour notice. In the event of termination within this period, advance payments made for lessons not yet conducted will be fully refunded.
Termination by the Instructor: The instructor may terminate the lesson services with a 48-hour notice.
Article 11. Force Majeure
"Parlons French" cannot be held liable if the execution of its obligations is delayed or prevented due to a case of force majeure, as defined by Article 1218 of the French Civil Code (including, but not limited to, widespread power grid or telecommunication network outages beyond the provider's control, serious illness, or accidents involving the instructor). Performance of the obligations will be suspended for the duration of the force majeure event, without compensation due from either party.
Article 12. Governing Law and Jurisdiction
These Terms and Conditions are governed by French law. In the event of a dispute relating to their interpretation or execution, and failing a prior amicable resolution, express jurisdiction is assigned to the Court of Besançon (France).
Article 13. Mediation Company
In accordance with the provisions of the French Consumer Code regarding the amicable settlement of disputes, the consumer Client may use the mediation service chosen by the provider free of charge:
Organization: Société Médiation Professionnelle (SMP)
Mailing Address: Alteritae, 5 rue Salvaing, 12000 Rodez, France
